Welcome to Vamp! These Terms of Service ("Terms") govern your access to and use of the Vamp mobile application, website, and related services (collectively, the "Services") provided by Vamp Mobility, Inc. ("Vamp," "we," "us," or "our").
By creating an account or using our Services, you agree to be bound by these Terms, our Privacy Policy, and any additional terms that apply to specific features of our Services. If you do not agree to these Terms, you may not use our Services.
IMPORTANT: These Terms contain an arbitration agreement and class action waiver that affect your legal rights. Please read Section 8 carefully.
Vamp operates a technology platform that connects riders seeking transportation with independent third-party transportation providers (drivers). Vamp is a marketplace and technology provider, not a transportation carrier, and does not provide transportation services directly.
All transportation services are provided by independent contractors who are not employed by Vamp. Drivers use their own vehicles and set their own schedules. Vamp does not control or direct how drivers perform transportation services.
Some rides may utilize AI-powered safety monitoring, autonomous vehicle features, or other advanced technologies. When applicable, you will receive appropriate notice and information about these features before your ride.
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. We may impose limits on certain features or restrict access to parts or all of the Services without liability.
You must be at least 18 years old to create a Vamp account and use our Services. By using our Services, you represent and warrant that you meet this age requirement.
To use certain features, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
We may require identity verification, including government-issued identification, phone number verification, and other information to ensure safety and prevent fraud.
Individuals seeking to provide services as drivers must pass a background check and meet all applicable requirements, including valid driver's license, vehicle registration, and insurance.

You will be charged for rides based on factors including distance, time, demand, and vehicle type. We provide upfront pricing estimates before you request a ride. Final charges may differ based on actual ride details.
You must provide a valid payment method to use our Services. You authorize us to charge your payment method for all fees incurred. Payment processing is handled by third-party payment processors.
Cancellation fees may apply if you cancel a ride after a driver has been assigned. No-show fees may be charged if you fail to appear for a scheduled pickup.
Promotional credits, discounts, and offers are subject to specific terms and conditions. Credits are not transferable, have no cash value, and may expire.
Refund requests are evaluated on a case-by-case basis. We reserve the right to refuse refunds for services properly rendered.
You are responsible for all applicable taxes. Taxes may be added to your fare where required by law.
We are committed to maintaining a safe platform. All users must comply with our Community Guidelines and Safety Standards, including treating others with respect, following traffic laws, and reporting safety concerns.
Our app includes safety features such as emergency contact buttons, ride sharing with friends, and 24/7 support. In case of emergency, always call local emergency services (911) first.
Users must report accidents, safety incidents, or violations of these Terms promptly through the app or by contacting support.
We may suspend or terminate accounts for violations of these Terms, safety concerns, fraudulent activity, or any other reason at our sole discretion.
The Services, including all content, features, and functionality, are owned by Vamp and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal use only.
The Vamp name, logo, and all related marks are trademarks of Vamp Mobility, Inc. You may not use our trademarks without prior written permission.
You and Vamp agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved through binding individual arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
You and Vamp agree that disputes will be resolved on an individual basis only. You waive any right to bring claims as a plaintiff or class member in any class action, collective action, or representative proceeding.
Arbitration will be conducted by a neutral arbitrator in accordance with the American Arbitration Association (AAA) Consumer Arbitration Rules. The arbitrator's decision is final and binding.
You may opt out of this arbitration agreement by sending written notice to digital@vamp.app within 30 days of first accepting these Terms.
Either party may seek injunctive relief in court to prevent actual or threatened infringement of intellectual property rights.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not guarantee that rides will be available at all times or locations, that drivers will accept ride requests, or that the Services will be uninterrupted or error-free.
You acknowledge that transportation services are provided by independent third-party contractors. Vamp is not liable for the acts, omissions, or conduct of drivers or other third parties.
TO THE FULLEST EXTENT PERMITTED BY LAW, VAMP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID TO VAMP IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
You agree to indemnify, defend, and hold harmless Vamp and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including attorney fees) arising from your use of the Services, violation of these Terms, or violation of any rights of another party.
We may terminate or suspend your account and access to the Services at any time, for any reason, without notice or liability, including for violation of these Terms. You may terminate your account at any time through the app settings or by contacting support.
Upon termination, your right to use the Services will immediately cease. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Subject to the arbitration agreement, any legal action or proceeding shall be brought exclusively in the federal or state courts located in Delaware.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and app, and updating the "Last Updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the modified Terms.
If you do not agree to the modified Terms, you must stop using the Services and may terminate your account.
These Terms, together with our Privacy Policy and any additional terms for specific features, constitute the entire agreement between you and Vamp regarding the Services.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.
You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms without restriction.
We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, or strikes.
